   The firm has to submit indemnity bond for material cost to be issued to the firm. When one loco is received by shop 16 after completion of piping work, and the scrap returned to CLW then the material for another locoset can be issued to the firm against the same indemnity bond if validity exists.

   Clause No 10 – Guarantee/defect Liability (refer page 18 of original tender document)
   Please Read following in the place of existing entry:
   The contractor will guarantee the workmanship of the work for a period of two years after the date of commissioning of loco. In case of joint leakage or other workmanship failure, the contractor will attend the same anywhere on Indian Railways.

   Clause No. 11- Time period (refer page 18 of original tender document)
   Read following in place of existing entry:
   After issue of LOA, the firm will be given 15 days for ground work.  Like preparation of storage area, arrangement of tools, zigs and fixtures, compressor line, issue of material from CLW etc.  Firm will intimate to CLW reg. its prepardness. After placement of loco shell, piping work of the 1st shell shall be completed within 30 days, 2nd shell shall be completed within 20 days & subsequent shell shall be completed within 15 days of its placement.

   Terminal date of contract will be one year after issue of clear work order.

   Clause No. 11A- Penalty clause (New)
   In case of delay firm will be penalized @5% per week or part thereof of contract value for one loco. Penalty shall be calculated on the basis of each loco.

   Clause No. 12 Payment terms(refer page 19 of original tender document)

   Read following in place of existing entry:
   80% payment of per loco contract value shall be paid to the contractor on completion of job and production of inspection certificate issued by an officer not below the rank of JAG level.  Remaining 20% payment shall be released after the loco dispatch from CLW backed by a letter issued by an officer not below the rank of JAG level.

“Indemnity Bond against Railway property: If any Railway properties like castings, components, machines etc. are to be taken by the contractor under their custody for the execution of work under the contract, the contractor shall submit necessary Indemnity Bond alongwith insurance for an amount as may be specified in the Special Conditions of Contract. However, the firm may/shall have to submit Bank Guarantee for the said purpose where it is being specifically asked for by the Railways”.

2. Clause No.5 of Special Conditions of Contract at Page-8 of the tender document is modified and shall be read as follows:

“Indemnity Bond - In order to cover the Railways’ risk of castings taken over by the firm for processing, the firm shall submit Indemnity Bond covered by insurance, having a total value equal to Rupees 14.35 lakh times total number of bogie castings proposed to be held in the custody of the firm at any time.
